CCPA Privacy Notice for California Residents

This Privacy Notice for California Residents supplements the information contained NavePoint’s Privacy Policy and applies solely to all visitors, users, and others who reside in the State of California (”consumers” or “you”). We adopt this notice to comply with the California Consumer Privacy Act (CCPA) and any terms defined in the CCPA have the same meaning when used in this notice.

Information We Collect

Our Website collects information that identifies, relates to, describes, references, is capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular consumer or device (”personal information”). In particular, NavePoint has collected the following categories of personal information from its consumers within the last twelve (12) months:

NavePoint obtains the categories of personal information listed above from the following categories of sources:

  • Direct interactions. You may give us your information by filling in forms or by corresponding with us by mail, phone, fax, email or in-person. This includes, but may not be limited to, personal data you provide when you:
    • Purchase our products or request samples;
    • Create a user account on our website;
    • Subscribe to our publications;
    • Request marketing be sent to you;
    • Interact with our website
    • Interact with social media by visiting NavePoint pages, commenting on or liking posts;
    • Enter a competition, promotion or survey; or
    • Provide information in-person at industry events or other venues, or providing information by phone, fax or email.

NavePoint will not collect additional categories of personal information or use the personal information we collected for materially different, unrelated, or incompatible purposes without providing you notice.

Sharing Personal Information

NavePoint may disclose your personal information to a third party for a business purpose. When we disclose personal information for a business purpose, we require that the recipient both keep that personal information confidential and not use it for any purpose except performing the contract.
We share your personal information with the following categories of third parties:

  • Professional advisers including lawyers, bankers, auditors and insurers who provide consultancy, banking, legal, insurance and accounting services.

Disclosures of Personal Information for a Business Purpose

In the preceding twelve (12) months, Company has disclosed the following categories of personal information for a business purpose:

  • Category B: California Customer Records personal information categories.
  • Category D: Commercial information.

We disclosed your personal information for a business purpose to the following categories of third parties:

  • Service providers acting as data processors.
  • Professional advisers including lawyers, bankers, auditors and insurers who provide consultancy, banking, legal, insurance and accounting services.

Sales of Personal Information

In the preceding twelve (12) months, Company had not sold any categories of personal information (for both minors and non-minors). NavePoint does not sell personal information to third parties.

Your Rights

Pursuant to Section 1798.100 et seq. of the California Civil Code, residents of California have certain rights with respect to their personal information. California residents may request the categories of personal information we collect for that consumer, categories of sources from which the personal information is collected, the business or commercial purposes for collecting that personal information, the categories of third parties with which we share that personal information, the categories of personal information we share with third parties for a business purpose, and the specific pieces of personal information we have for that consumer. In addition, residents of California may request that we delete any personal information that we may have for that California resident. NavePoint.com does not discriminate against any consumers because the consumer exercised any of the consumer’s rights under the California Consumer Privacy Act, including, but not limited to, by: (a) denying goods or services to the consumer; (b) charging different prices or rates for goods or services, including through the use of discounts or other benefits or imposing penalties; (c) providing a different level or quality of goods or services to the consumer; or (d) suggesting that the consumer will receive a different price or rate for goods or services or a different level or quality of goods or services.

PRIVACY NOTICE TO CALIFORNIA EMPLOYEES AND JOB APPLICANTS REGARDING THE COLLECTION OF PERSONAL INFORMATION

NavePoint, LLC (“NavePoint”) adopts this Privacy Notice to California Employees and Job Applicants Regarding the Collection of Personal Information (the “Privacy Notice”) to comply with the California Consumer Privacy Act (“CCPA”). Any terms defined in the CCPA have the same meaning when used in this Privacy Notice. NavePoint is committed to protecting the privacy and security of personal information. NavePoint is a company, in the course of its business, asks job applicants, prospective employees, and employees to provide personal information necessary relating to your employment or prospective employment. This Privacy Notice describes how NavePoint collects and uses your personal information, the categories of personal information it collects, and instances where NavePoint may disclose your personal information to third parties. NavePoint will only collect and process your personal information in accordance with this Privacy Notice, unless otherwise required by applicable law.

Categories of Personal Information NavePoint Collects and How We Use It

NavePoint collects and processes information from you for human resource, employment and benefit administration purposes, and where necessary to comply with any local, state, and federal legal obligations. NavePoint obtains the categories of personal information listed below directly from you and the information you provide during your job application process, your employee onboarding process, and during the selection of your benefits as an employee. In some cases, NavePoint may obtain a background check and/or consumer report from a consumer reporting agency once an offer of employment is made.

NavePoint collects the following categories of your personal information:

  • Personal identifiers you provide when you apply for a job, supply information for your benefits, or in context of your employment with us, such as your first and last name, your address, your email address, telephone number, date of birth, social security number, driver license number, passport number, and/or other government identification numbers, immigration and work authorization status, signature, and username and/or account name. NavePoint collects this information to make an employment and/or job related decision that involves you, to fulfill or meet the reason you provided the information as a job applicant or employee, to provide you with employment with NavePoint, to manage your employment relationship with us and for general employee administration and processing (including employee payroll and benefits administration), and to create, maintain, and secure your online employee accounts with NavePoint.
  • Financial information such as banking information for direct deposit, tax selections, pay rate, payroll deduction information. NavePoint collects this information for employee related human resource administration (including employee payroll and benefits administration), processing work-related claims (for example, insurance or payment claims), and all related accounting and auditing.
  • Benefit selection and related information such as your benefit selection, social security number or other government identification number, date of birth, health insurance information, policy number, and selections. NavePoint collects this information to administer benefit claims and for employee related human resource administration.
  • Biometric Information. NavePoint may collect Biometric Information (fingerprint). This information is used to track hours on a timeclock for hourly employees.
  • Professional and employment-related information such as current or past employment history, employee status and title, job evaluations, employment status, work schedule, job assignments, hours worked, training and development information, performance evaluation information, disciplinary and counseling information, and termination information. Navepoint collects this information to make an employment and/or job related decision that involves you, to fulfill or meet the reason you provided the information as a job applicant or employee, to provide you with employment with NavePoint, to assess qualifications for a particular job or task, conduct performance reviews and determine performance requirements, for education, training, and development requirements, and to gather evidence for disciplinary action or termination, for other human resource administration purposes, and to administer and process employee benefits.
  • Education information such as education history. NavePoint collects this information to evaluate and make an employment and/or job related decision that involves you, to provide you with employment with NavePoint to assess qualifications for a particular job or task, conduct performance reviews and determine performance requirements, for education, training, and development requirements.
  • Health and Safety Information such as health conditions, self-certifications/heath screening regarding symptoms of COVID-19, if relevant to your employment, job restrictions, workplace accident and illness information, and health insurance policy information. NavePoint collects this information to maintain a safe workplace, assess your working capacity and make necessary accommodations, administer health and Worker’s Compensation programs, and comply with applicable laws.
  • Beneficiary Information of your beneficiaries, such as name and contact information, relationship to you, birth date, social security or other government identification number, and any other information necessary to process any benefits claims. NavePoint collects this information to administer and process any related benefit claims.
  • Emergency Contact Information of person(s) you designate as your emergency contact(s) such as their name and contact information, and their relationship to you. NavePoint collects this information to maintain contact information should an emergency involving you arise during your employment.

NavePoint will not collect additional categories of personal information or use the personal information collected for materially different, unrelated, or incompatible purposes without first providing you with additional and/or updated notice.

Disclosure to Third Parties

NavePoint does not sell or otherwise disclose your personal information to any third parties for any monetary consideration. NavePoint only shares your personal information with service providers to the extent necessary in order to administer employee benefits, including for payment of wages, tax processing, and health insurance, and in connection with its human resource activities. NavePoint also discloses your information when required to by local, state, or federal law.

Changes to This Privacy Notice

NavePoint reserves the right to amend this privacy notice at our discretion and at any time. When we make changes to this privacy notice, we will post the updated notice on our website and update the notice's Effective Date above.
